Ramachandran, J:Delay in filing the appeal is condoned. There is defect in this appeal, since the parties have not been served with notice. However, we do not think it will restrain us from disposing of the above appeal. The relied on judgment in L.A.R.No.144 of 1997 had attained finality, since no appeal has been filed therefrom.
