JUDGMENT

The grievance of the petitioner, who is a last Grade Employee presently working in Performance Audit Unit 1, Venkintagu, is that even though she has got only a few months to retire on superannuation, she has been transferred to Pariyaram Panchayat in clear violation of Ext.P2 guidelines. The materials placed on record by the petitioner will indicate that the petitioner is having very serious health problems. She has already submitted Ext.P7 before the 2nd respondent against the impugned transfer order. Under these circumstances, this writ petition will stand disposed of with the following directions:

i). The first respondent will take up Ext.P7, consider the same in the light of the grounds raised in the writ petition and also the various documents placed on record, particularly Ext.P2 and the documents produced by the petitioner regarding her present health condition and take a correct and just decision on Ext.P7 at the earliest and at any rate within one month of the WPC No.32710/2006 2 first respondent receiving a copy of this judgment together with copies of all the relevant exhibits. ii). Till such time as a decision is taken as directed above on Ext.P7, the petitioner will be permitted to continue in the Audit Unit 1, Venkintagu notwithstanding Ext.P1 order.
