J U D G M E N T
The prayer made in this writ petition is for a direction to the respondents to consider Ext.P3 and dispose of the same in accordance with law. Ext.P3 is an application for temporary permit under Sec. 87(1)(d) of the Motor Vehicles Act, pending renewal of the regular permit. The petitioner has produced Ext.P5 order passed by this Court in a similar circumstances.
2. The learned Government Pleader appearing on behalf of the respondents submits that the facts stated in Ext.P5 cannot be treated as identical or similar with the facts of this case. However, in the above view the concerned authority has to consider Ext.P3 and dispose of the same in accordance with law. Having heard both sides and after considering rival contentions, the following order is issued.
3. The Secretary, RTA, Palakkad shall consider Ext.P3 and dispose of the same within 2 weeks from the date of receipt of a copy of this judgment. It is open to the petitioner to relay upon Ext.P5 and WP(C) No. 32823/2006 convince the authority that the facts of the present case is similar to the facts as stated in Ext.P5. Produce copy of this order before the Secretary, TRA for information and compliance.
