JUDGMENT

Basheer,J:

This appeal was admitted after condoning the delay. Notice was ordered to the respondent on August 28, 2006. However, the appellant has not remitted balance two third court fee payable on the Memorandum of Regular First Appeal; nor has he paid the process to issue notice.

2. Learned counsel for the appellant submits that the appeal may be rejected for non-payment of court fee. Accordingly, the appeal is rejected.

3. The court fee paid on the appeal memorandum shall be refunded, as provided under Section 66 of the Kerala Court Fees and Suits Valuation Act, 1959. (M.RAMACHANDRAN)
