Petitioner approached this court with certain grievances regarding the mode of assessment of welfare fund. It is seen from Ext.P4 order passed by the appellate authority that in case the workers are engaged only for 15 days, the contribution had to be decided accordingly. However, according to the petitioner in the case of the petitioner a different yardstick has been adopted, by assessing the liability for full months duty. There is no point in remitting the matter to the appellate authority. I quash Exts.P2 and P3. There will be a direction to the second respondent to consider the matter afresh based on the fair wages paid by the petitioner to the employees during the period 1999-2000 for 15 days. Orders as above shall be passed within a period of three months from the date of production of a copy of this judgment. The writ petition is disposed of as above.
