For Respondent : No Appearance
The Hon'ble MR. Justice PIUS C.KURIAKOSE
O R D E R
PIUS C. KURIAKOSE, J.W.P.(C) No. 32843 OF 2006
Dated this the 12th day of December, 2006
The petitioner will serve a copy of this Writ Petition on Sri. T.A.Shaji, who will thereupon take notice on behalf of the respondent- Panchayat. The grievance of the petitioner is that it was without issuing the mandatory notice under Section 235(x) of the Panchayat Raj Act, that the respondent-Panchayat interfered with the renovation work which he had taken up on his building. I do not propose to examine the merits of the above ground. But since Ext.P4 is seen pending before the Panchayat it is only appropriate that the Panchayat takes an early decision. The Writ Petition will stand disposed of with the following directions: If Ext.P4 is even now pending before the Panchayat, the Panchayat will take up the same, hear the petitioner and take a decision. The decision as directed above, will be taken by the Panchayat at their earliest and at any rate within three weeks of receiving a copy of this judgment.
