O R D E RThe petitioner is the first accused, in C.C.No.45/2006 on the file of the Judicial Magistrate of First Class, Alathur, which is basing on crime No.72/2001 of Vadakkancherry Police Station, and the petitioner, though had appeared before the Court on 6.3.2004, but absconded thereafter. A non bailable warrant was issued against him, by the Court below. Hence the petitioner is before this Court, under Section 438 Cr.P.C.
2. The learned Public Prosecutor submitted that the petitioner had absconded, after 6.3.2004. The submission of the counsel is that the address shown in the final report by the police, is incorrect and therefore, not even a summons was received by the petitioner.
3. After considering the submissions of either side, I direct the petitioner to appear before the Judicial B.A.4347/2006 2 Magistrate of First Class, Alathur, and the learned Magistrate shall allow him to be on bail, and proceed with the matter, according to the law.
