IN THE HIGH COURT OF KERALA AT ERNAKULAMWP(C) No. 25555 of 2003(P)
1. VIMAL ELIAS THOMAS, THOMSON MEDICALS,
1. THE ASST.DRUGS CONTROLLER AND
For Petitioner :SRI.J.JOSEPH
For Respondent :GOVERNMENT PLEADER
The Hon'ble MR. Justice KURIAN JOSEPH
O R D E R
KURIAN JOSEPH, J.W.P(C)No.25555 of 2003
Dated this the 12th day of December, 2006
The challenge is on Ext.P4 order passed by the respondent. It is seen from the impugned order as well as the counter affidavit that the same is passed as if there is no reply to Ext.P1 show cause notice. It is seen from Exts.P2 and P3 that the petitioner had submitted reply. Therefore, I quash Ext.P4. There will be a direction to the respondent to look into Exts.P2 and P3 and pass appropriate orders thereon expeditiously. While passing orders as above, the fact that the petitioner had already closed down the shop for a period of three days will also be considered by the respondents. The writ petition is disposed of as above.
