JUDGMENT

Petitioners are judgment debtors and respondent is the decree holder. This petition is filed under Article 227 of Constitution of India, seeking a direction to Sub Court, Palakkad to grant installment facility to the petitioner. The execution petition stand posted for sale of the property to 18.12.06. The total amount due as per sale paper is Rs.2,84,242/-. It is for petitioner to approach the executing court for permission to pay the balance decree debt in installments. If the petitioner files an application for granting permission to pay decree debt in installments after making a payment of Rs.40,000/-, on or before the day posted for sale, executing court has to adjourn the sale and pass appropriate order in the application and post the petition for sale only there after, if necessary.
