J U D G M E N T

The main prayer made in this writ petition against the respondent-Water Authority is that vacancy shall be reported by the Authority for direct recruitment of last grade servants from the rank list published by the Public Service Commission. The P.S.C. has to advise candidates from the list prepared by it for appointment of last grade servants in various departments under the Government or from the list published by it for appointment of last grade servants in the Boards, Companies, Authorities, etc. under the Government, as notified. The Water Authority cannot abdicate its functions by not reporting the vacancies to the P.S.C, properly.

2. The pleadings in the writ petition do not clearly furnish the exact number of vacancies of last grade servants as sanctioned by the competent authority and reportable to the P.S.C. for direct recruitment. However, the respondent-Authority shall assess the number of vacancies to be reported to the P.S.C. and WPC No.31493 /2006 -2- appropriate measures taken, as expeditiously as possible. Vacancies thus assessed and found reportable shall be reported to the P.S.C. for appointment of last grade servants under the Authority within two weeks on the petitioner producing a copy of the judgment before the respondent-Authority. The P.S.C. shall take appropriate action as ordained by the rules and regulations on the subject. K.K. DENESAN
