ORDERPetitioner who is the 2nd accused in Crime No.68/2002 of Sholayar Police Station for an offence punishable under sec.489B read with sec.34 IPC, seeks bail.
2. The petitioner was on bail during the crime stage of the case. After the committal of the case to the Sessions Court, Palakkad where the case is now pending as S.C.1136/2005, the petitioner did not appear. According to the petitioner he did not receive any summons. At a stage when non-bailable warrants of arrest issued against the petitioner by the Sessions Court were pending, he surrendered before that court on 26.8.2006. He filed an application for bail which was rejected and he was remanded to custody.
3. A1 to A3 who were also similarly placed have been granted bail by this court as per order dt.13.10.2006 in B.A.5998/2006. I do not think that the petitioner herein should be treated differently. Accordingly, the petitioner is directed to be released on bail on his executing a bond for Rs.25000/- (twenty five thousand) with two solvent sureties each for the like amount to the satisfaction of BA 7463/2006 2 the Sessions Judge, Palakkad and subject to the condition that the petitioner shall be present before the trial court on all the dates of posting of the above Sessions Court. This petition is allowed as above.
