M.SASIDHARAN NAMBIAR, J.W.P.C.NO.33451 OF 2006 (G)
Dated this the 18th day of December, 2006.
Petitioner is plaintiff and respondent defendant in O.S.106/06 on the file of Munsiff court, Paravur. This petition is filed under Article 227 of Constitution of India, for a direction to the Munsiff to pass order in Ext. P4 application filed by petitioner. In that suit, an ex-parte order of temporary injunction was granted in favour of petitioner. Under Ext.P4, petitioner sought police aid for constructing a compound wall. Argument of learned counsel appearing for petitioner was that in view of the order of injunction, court below should have granted an order of police protection in Ext.P4 application. It is for the learned Munsiff to decide whether the ex-parte order of temporary injunction granted by the court below in favour of the petitioner is to be made absolute or not. Learned Munsiff thereafter may decide, whether petitioner is entitled to police protection as sought for. Petition disposed accordingly. M.SASIDHARAN NAMBIAR,
