Petitioner who is the sole accused in C.C. No.16/2005 pending before the Court of Special Judge (SPE C.B.I.)-I, Ernakulam for an offence punishable under Sec.120B read with secs.409 and 477(A) I.P.C. and sec.13(2) r/w. sec. 13 (1)(C) of the Prevention of Corruption Act, seeks his enlargement on bail. He was once granted bail during crime stage on 14.12.2005. Subsequently consequent on his non-appearance before the trial court, the bond was forfeited and notices were issued to his sureties. Non- bailable warrant of arrest was issued against the petitioner. He was subsequently arrested and produced before the trial court on 13.12.2006. His application for bail was rejected by the court below on the same day. It is thereafter that the petitioner has approached this court.

2. Adv. Sri S.Sreekumar, the learned Standing Counsel for the C.B.I., submitted that the petitioner could be granted bail on appropriate conditions ensuring his presence for trial. Accordingly, the petitioner is directed to be released on bail on his executing a bond for Bail A.No.7596/2006 -:2:- Rs. 10,000/- (Rupees ten thousand only) with two solvent sureties each for the like amount to the satisfaction of the Special Judge (SPE C.B.I.)-I, Ernakulam and subject to the following conditions:-

1. The petitioner shall appear before the trial court on all the regular dates of posting of the case against him.

2. The petitioner shall not commit any offence while on bail. If the petitioner commits breach of any of the above conditions, the bail granted to him shall be liable to be cancelled. This application is allowed as above.
