J U D G M E N T
Exhibit P2 is under challenge. The allegation is that the petitioner has unauthorisedly consumed electricity in excess of the sanctioned unit. The contention of the petitioner is that demanding 1.5 times of the consumption charges is illegal and maximum that can be demanded is only 1= times of the fixed charges. However, he has got right of appeal before the Consumer Redressal Forum constituted under Section 42(5) of the Electricity Act.
2. In such circumstances, if the petitioner affords an appeal before the said authority along with deposit of an amount of Rs.5,000/-, the said authority shall consider the appeal and dispose of the same in accordance with law. On making the payment of Rs.5,000/- as aforesaid, the supply shall be restored. Writ petition is disposed of as above.
