ORDERPetitioner who is the 3rd accused in Crime No. 344/04 of Valiyathura Police Station for offences punishable under sections 465, 468 and 471 read with Sec. 34 of I.P.C. and Sec.3 read with 12 of the Indian Passport Act and presently Crime No. 469/CR/SI/04 of CBCID, Thiruvananthapuram, seeks anticipatory bail.
2. The learned Public Prosecutor opposed the application submitting inter alia that the other two accused persons are still absconding and that the only role of the petitioner was not merely introducing Rejitha Subrahmonian but also in sharing with A1 and A2 the sum of Rs. 25,000/- received from Rejitha for preparing forged emigration clearance.
3. Anticipatory bail cannot be granted to a person like the petitioner. There is no reason why the petitioner should not surrender before the investigating officer and then apply for regular bail. The petitioner shall surrender before the investigating officer within one week from today for the purpose of custodial interrogation and B.A. No. 7547 of 2006 -:2:- recovery of documents, if any. Thereafter, the petitioner shall be produced before the Magistrate having jurisdiction who shall consider and dispose of his application for regular bail, if any, filed by the petitioner, preferably on the same day on which it is filed.
