W.P.(C)NO. 383 OF 2006

Dated this the 3rd day of August, 2006

JUDGMENT

The petitioners are members of the 5th respondent - Society. The grievance of the petitioners is that respondents 6 to 10 who are residing beyond the area of operation of the Society have been inducted as members of the Society. Against the above, the fourth petitioner filed Exts.P5 and P6 representations and the third petitioner filed Ext.P7 representation before the fourth respondent.

2. Learned counsel for the petitioners submits that as per Rule 16 of the Kerala Co-operative Societies Rules, 1969, the above allegation has to be set right by the Registrar either on his own motion or on applications filed by interested parties. Since petitioners 3 and 4 have filed representations before the fourth respondent, there will be a direction to the 4th respondent to consider the representations, if he is empowered to do so, and take a decision thereon within a reasonable time, at any rate within 60 days from the date of receipt of a copy of this judgment. The Writ Petition is disposed of as above.
