JUDGMENT

The petitioner was appointed as Stamp Examiner by transfer from the post of Peon in the Treasury Department. She has since retired from service. Feeling dissatisfied with the date from which she was granted appointment to the higher post, this writ petition has been filed praying for a direction to the respondents to promote her with effect from the date of occurrence of vacancy viz., 1.7.1999 in the post of Stamp Examiner.

2. During the pendency of this writ petition, the petitioner filed Ext.P14 representation against Ext.P12 order passed by the Director of Treasuries declining the request of the petitioner. Counsel for the petitioner submits that the Government being the higher authority, it has the power to look into the grievance of the petitioner and examine the correctness of the decision taken by the Director of Treasuries.

3. I am inclined to agree with the above submission of the counsel and I feel that this writ petition can be disposed of issuing appropriate direction to the additional third respondent-Government.

4. Hence, there shall be an order directing the WPC 33436/2006 2 additional third respondent to consider Ext.P14 and pass orders in accordance with law as expeditiously as possible, in any event, within two months on the petitioner producing a copy of this judgment along with a copy of the writ petition.
