ORDERThis is an application for bail in a case where the accused is alleged to have committed offences under Sections 449 and 302 of I.P.C. He was arrested on 5.11.2006. It is submitted that the investigation is in progress.
2. The learned Public Prosecutor opposed the application on the ground that the accused is a gulf returnee and he may fly back, if bail is granted. When necessary conditions are incorporated which would safeguard the apprehension raised by the learned Public Prosecutor, there is no point in detaining him indefinitely. Therefore, the petition is allowed subject to the following conditions: (1) The petitioner is released on bail on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like amount to the satisfaction of the Judicial First Class Magistrate Court, Mavelikara. BA 7644/06 -: 2 :- (2) The petitioner shall surrender the passport before the Magistrate Court before being released on bail. (3) The petitioner shall report before the Investigating Officer on every Monday between 10 a.m. and 11 a.m. for a period of three months. (4) The petitioner shall not attempt to interfere with the investigation or attempt to intimidate or influence the witnesses. M.N. Krishnan, Judge. ess 29/12
