This is an application for bail under Section 438 of Criminal Procedure Code. The allegation against accused (petitioner) is that he along with others were found to be in possession of illicit liquor. The benefit under Section 438 cannot be used for circumventing law and procedure and to aid the people who are alleged to have involved in offences against the society. Therefore the bail application under Section 438 is dismissed. It is made clear that the petitioner is at liberty to surrender before the concerned Magistrate court and in that event Magistrate shall as fas possible try to dispose the bail application on the same day itself.
