O R D E RThe petitioner is the second accused, in crime No.230/2006 of Kannur City Police Station. The allegation against her and others are for the offence punishable under Section 52-A and punishable under Section 68-A of the Copy Right Act, 1957, and also under Section 292-A of IPC. It is alleged that the petitioner is the licensee of a shop, by name 'Jockers Audio and Video' at Melachovva, Kannur. At the time of the raid of the premises, four C.Ds with obscene materials in it, three C.Ds of cinema including 'Udayanan Tharam', 45 blank C.Ds and 15 covers of C.Ds were seized. These materials reveal that the accused were engaged in illegally copying various materials, in violation of the Copy Right Act.
2. The learned Public Prosecutor opposed of granting of an order, under Section 438 Cr.P.C.
3. Considering the materials on record, I direct B.A.4824/2006 2 the petitioner to surrender before the Investigating Officer, who is investigating crime No.230/2006 of Kannur City Police Station, on 23.8.2006.
4. The Investigating Officer shall interrogate the petitioner in the presence of a woman police officer and thereafter, produce her, as per the law, before the Judicial Magistrate of First Class-II, Kannur. The learned Magistrate shall consider the bail application that would be filed by the petitioner and pass orders, according to the law, on the date of production itself.
