O R D E RThe petitioner had surrendered before the Court below on 8.8.2006, as he was found in illegal possession of 5.25 liters of Indian made foreign liquor, on 29.4.2003, and C.R.No. 7/2003 of Excise Range, Pala, was registered against him, for the offence punishable under Section 55(a) of the Abkari Act. He remains in judicial custody. Hence this application, under Section 439 Cr.P.C.
2. The learned Public Prosecutor submitted that the investigation is complete and the matte is now pending before the Judicial Magistrate of First Class, Pala, as C.P.No.2/2006.
3. After hearing both sides and considering the
materials on record, I grant bail and release the petitioner
from jail, subject to the following condition:-
(a). The petitioner shall execute a bond for Rs.25,000/-, with two solvent sureties, each for the like sum, to the satisfaction of the Judicial Magistrate of First Class, Pala. The application is allowed as above. J.M.JAMES
