O R D E RThe petitioner was arrested on 29.6.2006, with three liters of illicit arrack, by the Excise Range Officials, Kottarakkara, and C.R.No.122/2006 of that Excise Range was registered, for the offence punishable under Section 8 (1) & (2) of the Abkari Act. He remains in judicial custody, as remanded by the Court below. Hence this application, under Section 439 Cr.P.C.
2. The learned Public Prosecutor submitted that the petitioner is also accused of two other cases.
3. After hearing both sides and considering the
duration of the judicial detention, I grant bail and
the petitioner from jail, subject to the following
(a). The petitioner shall execute a bond for Rs.25,000/-, with two solvent sureties, each B.A.4253/2006 2 for the like sum, to the satisfaction of the Judicial Magistrate of First Class-I, Kottarakkara.
(b). The petitioner shall report before the Investigating Officer, once in a week, on every Saturday, between 10.00 a.m and 11.00 a.m., for a period of two months, starting from 2.9.2006. The application is allowed as above. J.M.JAMES
