O R D E RThe petitioner is the accused, in crime No.129/2006 of Viyyur Police Station, for an offence punishable under Section 498A IPC. The prosecutor submits that the wife of the petitioner committed suicide and therefore, the investigation is going on, to add a further section of offence. The petitioner is a police constable. The crime was originally registered and as the investigation is going on, the prosecutor submits that the petitioner is required for interrogation. Certain medical records are also produced by the petitioner, to show that the deceased wife of the petitioner had undergone psychiatric treatment from different doctors.
2. In the facts and circumstances of this case, I direct the petitioner to surrender before the Court below, on 10.7.2006 at 11.00 a.m. The petitioner may move an application for bail, after serving copy of the same, to the B.A.3939/2006 2 Public Prosecutor. The prosecution also may move an application for the custody of the petitioner.
3. After hearing both sides, the learned Magistrate shall dispose of the matter, according to the law, passing appropriate orders. The application is disposed of as above. J.M.JAMES
