O R D E RThe petitioner is the first accused, in crime No.202/2006 of Nooranad Police Station for the offence punishable under Section 8(1) & (2) as well as 55(a) of the Abkari Act. It is alleged by the prosecution that on 15.6.2006, 900 liters of spirit had been transported in a vehicle, owned by the petitioner. He was arrested on 17.7.2006, and remains in judicial custody, thereafter. Hence this application, under Section 439 Cr.P.C.
2. After hearing both sides and considering the
facts that are placed before me and the
duration of the
judicial detention, I grant bail and release the petitioner
from jail, subject to the following
(a). The petitioner shall execute a bond for Rs.25,000/-, with two solvent sureties, each for the like sum, to the satisfaction of B.A.5429/2006 2 the Judicial Magistrate of First Class, Mavelikkara.
(b). The petitioner shall report before the Investigating Officer, once in a week on every Friday, between 10.00 a.m and 11.00 a.m., for a period of two months, starting from 15.9.2006. The application is allowed as above. J.M.JAMES
