O R D E RThe petitioner is before this Court, under Section 438 Cr.P.C., as he apprehends arrest, in crime No.138/2006 of Poochakkal Police Station, for the offence punishable under Section 308 IPC. It is alleged that the petitioner had inflicted stab injuries on the defacto complainant, the seat of the injury being on the chest of the complainant.
2. After hearing both sides and considering the nature of the injuries, sustained by the defacto complainant, and other aspects placed before me, I direct the petitioner to surrender before the Investigating Officer, who is investigating crime No.138/2006 of Poochakkal police station on 25.9.2006 between 10.00 a.m and 10.30 a.m.
3. The Investigating Officer shall interrogate the petitioner and produce him before the Court below, as per B.A.5600/2006 2 the law.
4. The learned Magistrate, on production of the accused, shall hear both sides and pass appropriate orders on merit. The application is disposed of as above. J.M.JAMES
