O R D E RThe petitioner is before this Court, as he is accused of the offence punishable under Section 8(1) & (2) as well as 55(a) of the Abkari Act. The petitioner is the second accused and he, along with another, was found in illegal possession of 70 liters of spirit on 14.12.2004. Thrikunnapuzha Police Station authorities registered crime No.183/2004 of that police station, against both the accused. The investigation is complete and the matter is now pending as C.P.No.103/2006 before the Judicial Magistrate of First Class-II, Haripad. The prosecution submits that the petitioner was shown as accused absconding in the charge.
2. After hearing both sides and considering the materials on record, I direct the petitioner to surrender before the Judicial Magistrate of First Class-II, Haripad, on 26.9.2006. B.A.5691/2006 2
3. The learned Magistrate shall allow the petitioner to be on bail, imposing such conditions, as are deemed necessary, so that the petitioner would be available before the Court below, for facing the trial. The application is disposed of as above. J.M.JAMES
