O R D E RThe petitioner is the second accused. He surrendered before the Court below, as per the direction of this Court, on 12.9.2006, and he had been remanded by the Court below. The quantity seized from the accused 1 and 2 are 3.5 liters of Indian made foreign liquor. The first accused was selling the same in the shop of the second accused, alleges the prosecution. Now the petitioner is before this Court, under Section 439 Cr.P.C.
2. After hearing both sides and considering the
duration of the judicial detention, together with the
act attributed to the accused 1 and 2, I grant bail and
release the petitioner from
jail, subject to the following
(a). The petitioner shall execute a bond for Rs.25,000/-, with two solvent B.A.5681/2006 2 sureties, each for the like sum, to the satisfaction of the Judicial Magistrate of First Class-I, Punalur.
(b). The petitioner shall report before the Investigating Officer, once in a week, on every Tuesday, between 10.00 a.m and 11.00 a.m., for a period of one month, starting from 26.9.2006. The application is allowed as above. J.M.JAMES
