Aggrieved by the inaction on the part of the first respondent - Registrar of Co-operative Societies, Thiruvananthapuram in taking a decision on Ext.P4 petition, the petitioner has filed this Writ Petition.
2. It is the case of the petitioner that the 4th respondent made appointments to the post of Gold Appraiser without following the statutory provisions and hence he filed Ext.P3 petition before the first respondent. Learned counsel appearing for the 4th respondent also submits that appointments have already been made. This Court is of the view that the first respondent should verify whether the appointments made are in accordance with the provisions of the Kerala Co-operative Societies Act, 1969 and the rules framed thereunder. Accordingly, the Writ Petition is disposed of with a direction to the W.P.(C)NO.2694/2006 2 second respondent to consider Ext.P4 petition (though Ext.P4 is submitted before the first respondent) after hearing the petitioner and other interested parties including the Bank and take a decision thereon as early as possible, at any rate within three months from the date of receipt of a copy of this judgment. The petitioner shall produce a copy of this judgment along with a copy of Ext.P4 before the second respondent for compliance.
