J U D G M E N T

The petitioner is a Preventive Officer working in the Excise Department. He is a native of Payyannur. By Ext.P1 order dated 31-5-2006, he has been transferred from the Excise Range Office , Taliparamba to Kannur. Now, by Ext.P2, he has been shifted from the present office to the Excise Check Post at Koottupuzha. He has preferred Ext.P4 representation against the present transfer, pointing out the personal inconveniences caused to him, by the transfer. He submits, he is a diabetic patient and he is not able to travel to Koottupuzha every day which is at a distance of about 90 kilometers.

2. This Court can interfere with a transfer order, if it is shown to be illegal or vitiated by malafides. Posting of excise officials are made in exigencies of service. May be a good officer is required at the check post and therefore the petitioner might have been preferred. This Court cannot interfere with such administrative decisions concerning the posting of excise officials to various places. But, if Ext.P4 is received and pending, the first respondent will consider and pass orders on it, in accordance with law, within two weeks from the date of WPC No. 18075 of 2007 2 receipt of a copy of this judgment.
