1. EXECUTIVE ENGINEER,
For Petitioner :SMT.P.K.RADHIKA
For Respondent : No Appearance
The Hon'ble MR. Justice S.SIRI JAGAN
O R D E R
S. SIRI JAGAN, J.W.P.(C)NO. 18103 OF 2007
DATED THIS THE 15th DAY OF JUNE, 2007
The petitioners challenge Ext.P2 by which the arrears of licence payable by the petitioner in respect of his shop room in the Malampuzha garden has been fixed as Rs.32,000/-. Since the petitioners themselves signed Ext.P2 in acknowledgment of their liability, I do not think that they can now challenge the same. In view of this position, the learned counsel for the petitioners submits that the petitioners may be given some time to pay off the amounts.
2. In the above circumstances, the writ petition is disposed of directing the respondents to permit the petitioners to pay the amounts due in three instalments payable on 2.7.2007,1.8.2007 and 4.8.2007. If the petitioners pay instalments as directed above, further coercive proceedings shall be kept in abeyance. However, if the petitioners commit default in payment of any of the instalments, the respondents would be free to proceed further. Accordingly, the writ petition is disposed of as above.
S. SIRI JAGAN, JUDGEAcd
