ORDERLearned counsel for the petitioner prays, learned Public Prosecutor does not oppose the said prayer and I am satisfied that the petitioner who faces the allegation under the Kerala Abkari Act that he was found in possession of 18 litres of arrack on 14.5.07 and who continues in custody till date, can now be enlarged on bail, subject to appropriate conditions.
2. In the result the bail application is allowed . The petitioner shall
be released on bail on the following terms and
i) He shall execute a bond for Rs.50,000/-(Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate. ii) The petitioner shall make himself available for interrogation before the investigating officer between 10 a.m. and 12 noon on all Mondays and Fridays, until further orders.
