Since the order impugned is deemed to have been passed under Section 204(4) of Code of Criminal Procedure by which the complaint itself has been dismissed, the special leave to appeal will not lie. In the above circumstances, the learned counsel for the petitioner submits that he may be permitted to withdraw the matter without prejudice to his right to seek the remedy as per law. Permission is granted and the matter stands dismissed as withdrawn. Dismissal of this petition will not be an objection to the petitioner for seeking her remedy as per law.
