Dated, this the 19th day of June, 2007
H.L. DATTU, CJ. There are two prayers in this writ petition. The first one is to quash Ext.P1 and the second one is to direct the respondents to evict all illegal encroachments and to carry on the demolition drive in illegal structures irrespective of any classification.
2. In so far as the first prayer is concerned, the learned Senior Government Pleader appearing for the respondents would submit that the State Government has already withdrawn Ext.P1. We do not doubt the correctness or otherwise of the statement made by the learned Government Pleader. Therefore, the first prayer sought for by the petitioner does not survive for our consideration in this writ petition. Accordingly the same is rejected.
3. In so far as the second prayer is concerned, it is for the State Government and not for us to direct the State Government to evict all unauthorised occupants from the government properties. In that view of the matter, the second relief also requires to be rejected and it is rejected. The writ petition is therefore dismissed. Ordered accordingly. H.L. DATTU, CHIEF JUSTICE. K.T. SANKARAN,
