Application for regular bail. The petitioner is the 17th accused. He, along with the co-accused, faces allegations inter alia under Sections 402 and 308 I.P.C. The crux of the allegations is that on 07/05/2007, on coming to know that a group of miscreants are taking shelter in a house and planning some operation, police people zeroed in on their house. There, the police party was attacked by the persons in the house by hurling a bomb at them. The miscreants took to their heals. Three of them including the petitioner were arrested later on 14/5/2007. Investigation is in progress. The petitioner continues in custody from 14/5/2007. The learned counsel for the petitioner submits that the petitioner is absolutely innocent. The police have received sufficient time by now to complete the investigation. In these circumstances, it is prayed that the petitioner may be enlarged on bail.

2. The application is opposed by the learned Public B.A.No.3673/07 2 Prosecutor. Investigation is not complete. The police may be given some further time to complete the investigation. It will be inexpedient to release the petitioner on bail at this early stage, submits the learned Public Prosecutor.

3. I find merit in the opposition by the learned Public Prosecutor. This, I am satisfied, is a fit case where police must be given some further time to complete the investigation. It is too early to consider the question of release of the petitioner on bail.

4. In the result, this petition is dismissed. But I may hasten to observe that it shall be open to the petitioner to move this court or the learned Sessions Judge for bail at the later stage of the proceedings, not at any rate, prior to 02/07/2007. The police shall, in the meantime, make every endeavour to complete the investigation.
