O R D E R

Application for regular bail. The petitioners face allegations of having committed an offence punishable under Section 55(a) of the Kerala Abkari Act. They were allegedly found to be in possession of about 400 litres of spirit on 13.2.2007. They were arrested in some other crime. They were directed to be produced before the Magistrate. Their arrest was recorded in this case on 20.3.2007. Investigation is complete. Final report has already been filed. They continue in custody from 20.3.2007.

The learned counsel for the petitioners prays, the learned Public Prosecutor does not seriously oppose the said prayer and I am satisfied that, the investigation having been completed and the petitioners having been in custody for a period of about 3 months, the petitioners can now be enlarged on bail subject to appropriate terms and conditions. The allegation is serious. The magnitude of the operation is huge. But, inspite of all that, I am satisfied that they can now be enlarged on bail subject to appropriate terms and conditions. 3. In the result: 1) This application is allowed. 2) The petitioners shall be released on bail on the following terms and conditions.

(a) They shall execute bonds for Rs.1,00,000/- (Rupees one lakh only) each with two solvent sureties each for the like sum to the satisfaction of the court, before which the case against them is pending.

(b) They shall make themselves available for interrogation before the Investigating Officer between 10 a.m. and 10.30 a.m. on the first Monday of all English calender months until the case against them is finally disposed of. (R. BASANT) Judge tm
