JUDGMENT

I do not propose to go into the merits of the matter. The grievance of the petitioners who are elected councilors of Kottayi Grama Panchayat is that respondents 1 and 2 (Secretary and the President of the Panchayat) have prepared beneficiary lists for payment of subsidy under the scheme called "Kerala Vikasana Padhathi 2006 - 2007" in gross violation of the applicable norms. It is alleged that the list presently prepared is the result of corruption. I am of the view that petitioners should seek their remedies from the Ombudsman for Local Self Government Institutions.

2. I relegate the petitioners to their remedies before the Ombudsman for Local Self Government Institutions. However, in view of the assertion of the learned counsel for the petitioners that actual release of the benefits have not been made to respondents 3 to 5, there will be a direction that in  WPC No.1570/2007 2 pursuance of Exts.P2 to P4, payments will not be made for a period of one month from today. It is open the petitioners to file necessary application before the Ombudsman for the Local Self Government Institutions to have an early disposal of the complaint to be submitted by them. I am sure that the Ombudsman will pass appropriate orders on that application. PIUS C.KURIAKOSE Judge dpk
