ORDER

The petitioners are accused 3 and 4 in Crime No.168/07 of Munnar Police Station. The investigation in the crime is now conducted by the C.B. C.I.D., Pathanamthitta, after re- registering the crime as Crime No.127/CR/KTM/07. Investigation is in progress. I have already, by order in B.A.No.3421/07 passed today, granted anticipatory bail to accused 1 and 2. The petitioners also seek anticipatory bail.

2. The learned Director General of Prosecution submits that the State has no objection in granting anticipatory bail to the petitioners herein also on identical conditions as in the case of accused 1 and 2. I am, in these circumstances, satisfied that, without further discussions, such directions can be issued.

3. In the result, this petition is allowed. Following B.A.NO. 3803 OF 2007 -: 2 :- directions are issued under Sec.438 of the Cr.P.C as in the earlier case:

(i) The petitioners shall appear before the learned Magistrate having jurisdiction at 11 a.m. on 2/7/07. They shall be released on regular bail on their executing bonds for Rs.25,000/- each with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate. (ii) The petitioners shall make themselves available for interrogation before the Investigating Officer between 10 a.m. and 12 noon on 3/7/07 and thereafter they shall make themselves available for interrogation before the Investigating Officer as and when directed by the Investigating Officer in writing to do so. (iii) If the petitioners do not appear before the learned Magistrate as directed in clause (i), directions issued above shall thereafter stand revoked and the police shall be at liberty to arrest the petitioners and deal with them in accordance with law as if those directions were not issued at all; (iv) If the petitioners were arrested prior to their surrender on 2/7/07 as directed in clause (i) above, they shall be released B.A.NO. 3803 OF 2007 -: 3 :- on their executing bonds for Rs.25,000/- each without any sureties undertaking to appear before the learned Magistrate on 2/7/07.
