O R D E R

Application for regular bail. The petitioner faces allegations under Section 55(a) of the Kerala Abkari Act. He was allegedly found to be in possession of 420 litres of spirit. The allegation is that the petitioner was engaging himself in the activity of filling spirit in sealed packets. He was arrested on 23.4.2007. He continues in custody from that date.

2. It is unnecessary to advert to the various other facts, as it is conceded that charge sheet has not so far been filed and a period of 60 days have been elapsed from the date of first remand. In these circumstances the petitioner is entitled for bail for default under Section 167 Cr.P.C. I am satisfied that the petitioner can be granted bail subject to appropriate terms and conditions.

3. In the result: 1) This application is allowed. 2) The petitioners shall be released on bail on the following terms and conditions. B.A.No. 3851 of 2007 2

(a) The petitioner shall execute a bond for Rs.1,00,000/- (Rupees one lakh only) with two solvent sureties each for the like sum to be satisfaction of the learned Magistrate.

(b) The petitioner shall make himself available for interrogation before the Investigating Officer between 10 a.m. and 12 noon on all Mondays and Fridays until further orders. (R. BASANT) Judge tm
