ORDER

Application for regular bail. The petitioner is the 8th accused. He along with co-accused faces allegations under Section 308 and 332 I.P.C. He allegedly had caused hurt to a public servant - police officer, who had reached the scene of crime of an offence punishable under Section 304 A I.P.C. No serious injury has been suffered by the victim. The alleged incident took place on 06.09.2006. Investigation is in progress. The petitioner was arrested on 12.06.2007. He continues in custody from that date.

The learned counsel for the petitioner prays, the learned Public Prosecutor does not seriously oppose the said prayer and I am satisfied in the facts and circumstances of this case that the petitioner can now be enlarged on bail subject to appropriate terms and conditions. In coming to this conclusion, I have taken note of the fact that even allegedly there were protest of local persons against inaction on the part of the police in not reaching the scene of the crime promptly. Appropriate conditions can, of course, be imposed.

3. In the result, this application is allowed. The petitioner shall be released on bail on the following terms and conditions. B.A.No.3814 of 2007 2

i) The petitioner shall execute a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate; ii) The petitioner shall make himself available for interrogation before the Investigating Officer as and when directed by the Investigating Officer in writing to do so.
