Radhakrishnan,J.Application is preferred to call for the entire records leading upto Annexure A6 and for a direction to the respondents to confirm the auction based on the quotations and bids made on 30.6.2006 and also for other consequential reliefs. Counsel for Guruvayoor Devaswom submitted that they have decided to re-tender on the basis of the decision taken by the Managing Committee on the basis of the report dated 6.1.2007 stating that the negative film of the featre film "Guruvayur Mahathyam" are kept in the Vijaya Colour Lab at Madras and it has no sound and the picture is not seen clearly. The Managing Committee which met on 10.2.2007 has resolved to re-tender the film for getting a better amount. We find no illegality in the decision taken by the Managing Committee. The amount paid by the petitioner by DBA 51/07 -: 2 :- way of E.M.D. shall be refunded to the petitioner with interest 9% from the date of receipt of the amount, till payment.
