R.BASANT, JB.A.No.3897 of 2007
Dated this the 28th day of June, 2007
ORDERApplication for anticipatory bail. The apprehension of the petitioner is that a crime alleging matrimonial cruelty may be registered against the petitioners and they may be arrested. The learned Public Prosecutor on instructions submits that though a complaint has been received from the wife of the 3rd petitioner, the police are not satisfied that any crime deserves to be registered. It is submitted that the petitioners shall not be arrested on the basis of the allegations referred to in the bail application.
2. I take note of and record the submissions of the learned Public Prosecutor. In these circumstances, the apprehension of the petitioners is found to be without any basis. This application is, accordingly dismissed. Needless to say that if any later decision is taken to register any crime against the petitioners and effect their arrest, that fact will be reported to this Court and prior permission sought and obtained.
