J U D G M E N T

Petitioner is the son of one K.K. Vijayan, who is the defaulter for public revenue due on land. The properties were sold in public auction on 11.1.07. Petitioner has preferred Ext.P2 petition under Section 53 of the Kerala Revenue Recovery Act alleging fraud and material irregularity in the matter of conduct of sale. In such circumstances, after hearing both sides, there will be a direction to the District Collector, Ernakulam to consider and dispose of Ext.P2 petition after affording an opportunity for hearing to the petitioner and also to the auction purchaser. Petitioner can produce all the materials, which he places reliance on, before the District Collector. Thereupon the District Collector will pass orders and communicate the same to the parties. Further proceedings pursuant to the same however will stand deferred till disposal of Ex.P2. Petitioner may produce a copy of the order before the District Collector for information and compliance. The writ petition is disposed of as above.
