ORDERThe petitioner has surrendered his passport before the learned Magistrate as condition for grant of bail. The petitioner now prays that the passport may be released to him to enable him to renew the visa. The petitioner undertakes that the passport shall be surrendered to the learned Magistrate within a period of three months.
2.The learned Public Prosecutor only airs the apprehension that the petitioner may not return, if the passport is released to him. I am satisfied that subject to appropriate conditions the passport can be released to the petitioner.
3. In the result this petition is allowed. The passport
surrendered by the petitioner shall be released to him
on the following
terms and conditions:-
i) He shall produce the passport before the learned Magistrate within a period of 3 months from the date on which it is released. ii) The petitioner shall execute a further bond for Rs.5 lakhs with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate, undertaking to return the passport as stipulated in Clause (i) above.
