O R D E RPetitioner who is the 3rd accused in Crime No.451/2006 of Cherthala Police Station for offences punishable under Secs.143, 147, 148, 294(b), 323, 324 and 308 read with sec.149 I.P.C., seeks anticipatory bail. The occurrence took place at 11.40 p.m. on 26.10.2006 during the course of which the de facto complainant is alleged to have been hit by the four accused persons with an iron block.
2. The learned Public Prosecutor opposed the application.
3. Anticipatory bail cannot be granted in a case of this nature having regard to the submission made by the learned Public Prosecutor that the petitioner is an anti- social element of that locality. There is no reason why the petitioner should not surrender before the Magistrate concerned and seek regular bail. Accordingly, if the petitioner surrenders before the Magistrate and files an Bail A.No.252/2007 -:2:- application for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same day on which it is filed. With the above observation this petition is disposed of.
