JUDGMENT

The petitioner's husband was an employee of the respondent bank. He was removed from the service of the bank by imposing a punishment of compulsory retirement on 03.08.2005. He did not challenge that order and so, it has become final. Later, he died on 15.03.2007.

2. The petitioner now submits that she is in great financial difficulties and prays for appointment in the bank on compassionate ground. She has preferred Ext.P1 representation claiming this relief. Thereafter this writ petition is filed seeking a declaration that the petitioner is entitled to be appointed in a suitable post in the respondent bank. She prays for a mandamus to the bank to appoint her. In the alternative, she prays for a direction to consider Ext.P1 representation. The petitioner has not stated in the writ petition about the Rule of the bank under which the petitioner is entitled to claim appointment on compassionate ground. The W.P.(C) No.21269 of 2007 petitioner's husband did not die while he was in service. He died after more than two years of his removal from service. Therefore, this writ petition is not maintainable. Accordingly, it is dismissed. Sd/- (K.BALAKRISHNAN NAIR)
