JUDGMENT

Petitioner is a High School Assistant working now in the Government Higher Secondary School, Kundamkuzhy on deployment. It is the case of the petitioner that he has been deployed in the above school as High School Assistant (English) though he is entitled to get posting in the Government High School, Thayannur as HSA (Social Studies). He seeks to quash Exts.P5 and P8 orders passed by respondent no.1.

2. Anyhow, I do not propose to deal with the contentions raised by the petitioner at this stage, since the statutory appeal preferred by him is pending consideration before respondent no.4. The said fact is seen admitted in the counter affidavit filed by respondent no.4 as well. Learned Government Pleader submits that a decision on Ext.P9 appeal will be taken without any further delay.  W.P.(C)No.15561 OF 2007

In the above facts and circumstances, writ petition is disposed of with a direction to respondent no.4 to consider and pass orders on Ext.P9 strictly on its merit and in accordance with law as expeditiously as possible, at any rate, within three months from the date of receipt of a copy of this judgment. Needless to mention that the petitioner shall be afforded sufficient opportunity to be heard before any decision is taken in the matter. Petitioner shall produce a copy of the writ petition along with a certified copy of the judgment before respondent no.4 for compliance. Writ petition is disposed of as above.
