M.N.KRISHNAN, J.Tr.P.C.No. 133 OF 2007
Dated this the 16th July, 2007.
This transfer petition is filed to transfer O.P.(HMA) 983/05 and O.P.(G&W) 129/01 pending before the Family Court, Nedumangad to the Family Court at Thiruvananthapuram. It appears that another case between the same parties as O.P.696/00 is pending before the Family Court, Thiruvananthapuram. It is for claiming maintenance and value of 25 sovereigns gold ornaments. The other petitions are one for divorce and custody of the child. After the formation of the new court at Nedumangad two cases had been transferred to that Family Court and only this case is retained. I feel, in order to do effective justice to all parties, it is desirable that all the cases are tried by one and the same court. Since the family court has transferred two cases to the family court at Nedumangad, I feel the case pending before the Family Court, Thiruvananthapuram as O.P.696/00 can also be transferred to the Family Court at Nedumangad. The additional constitution of family courts had been necessitated only on account of large pendency of cases. Therefore, for an effective and speedy adjudication I direct O.P.696/000 also be transferred to the Family Court Tr.P.C.133/07 2 at Nedumangad for trial and disposal. If both the parties find it extremely difficult they can approach this court for further directions. Transfer petition is disposed of accordingly. M.N.KRISHNAN Judge jj
