ORDERThe petitioner faces allegations under Sec.353 of the IPC. He has been granted bail subject to conditions by the learned Magistrate. One of the conditions is that the petitioner must surrender his passport. The passport has, accordingly, been surrendered before the learned Magistrate, submits the learned counsel for the petitioner. The petitioner now wants return of the passport. According to me, the petitioner must make an application before the learned Magistrate for such return of the passport specifying the nature of the need and the period during which he wants the passport in his possession. When such application is filed giving details, the learned Magistrate must, after hearing the prosecution, consider such application and pass appropriate orders. I do not find it necessary to issue any omnibus directions now, the Crl.M.C.NO. 2212 OF 2007 -: 2 :- petitioner having been enlarged only as per the order dated 23/5/07.
2. With the above observations, this Crl.M.C. is dismissed.
3. Hand over a copy of this order to the learned counsel for the petitioner. Sd/-
