JUDGMENT

Petitioner who is stated to be working as Higher Secondary School Teacher (Hindi) in the school under the management of respondent no.4 has preferred this writ petition contending inter alia that she is eligible to get her pay and allowance fixed in the revised pay scale sanctioned in G.O. (P)No.145/06/Fin. Dated 25.3.2006. Ext.P6 is the copy of the statement of fixation of pay in the revised scale and Ext.R6(a) is the form of option. Petitioner further contends that Ext.P7 is the copy of the communication issued by respondent no.3 while forwarding the above documents. The limited prayer is to issue an appropriate direction to respondent no.3 to take a decision on Exts.P6 and P6(a) for fixation of the pay scale of the petitioner in terms of the revised pay scale. Learned Government Pleader submits that respondent no.3 will take a decision in the matter, if Exts.P6 and P6(a) have been submitted as contended by the petitioner. W.P.(C)No.21018 OF 2007

In the above facts and circumstances, writ petition is disposed of with a direction to respondent no.3 to consider and pass orders on Exts.P6 and P6(a) strictly on their merit and in accordance with law as expeditiously as possible, at any rate, within six weeks from the date of receipt of a copy of this judgment. Needless to mention that petitioner and the manager of the school shall be afforded sufficient opportunity to be heard before any decision is taken in the matter. Petitioner shall produce a copy of the writ petition along with a certified copy of the judgment before respondent no.3 for compliance. Writ petition is disposed of as above.
