Crl.M.C.No.2292 of 2007

Dated this the 18th day of July 2007

O R D E R

In favour of the petitioner, who faces allegations under Section 498A I.P.C, directions under Section 438 Cr.P.C were issued on 08/06/2007. Those conditions were to remain in force for a period of one month, by which date, the petitioner was to surrender before the learned Magistrate and seek regular bail. According to the learned counsel for the petitioner, the petitioner has already appeared before the learned Magistrate and has been enlarged on regular bail. He is not able to specify whether such release is on the strength of any condition or not. The petitioner has now come to this court to delete the condition imposed as per the order dated 08/06/2007. The anticipatory bail granted is not in force now, a period of one month having already elapsed from 08/06/2007. The petitioner is not obliged to comply with the conditions imposed as per order dated 08/06/2007, the period having already expired. He must now comply with the conditions, if any, imposed by the learned Crl.M.C.No.2292/07 2 Magistrate while granting regular bail. If the conditions in the order dated 08/06/2007 have been re-imposed by the learned Magistrate in the order granting regular bail, the petitioner shall have to comply with those conditions. He must seek relaxation of those conditions before the learned Magistrate.

2. This petition is, in these circumstances, dismissed with the above observations.
